CIRC and Colorado’s community supports the Justice Department’s Request to rehear U.S. v. Texas by the Supreme Court

Denver, CO - The U.S. Department of Justice petitioned the Supreme Court to rehear the case of United States v. Texas, the DAPA and expanded DACA immigration relieve case for which the divided Court failed to issue a decision last term. Implementation of expanded Deferred Action for Childhood Arrivals, or DACA+, and Deferred Action for Parents of Americans and Lawful Permanent Residents, or DAPA, has been blocked for more than over a year.

 

By filing a petition for rehearing, the government is giving the Court the option to retain the case so that the Court can address the unresolved issues as soon as it has nine Members in the Supreme Court.

 

The U.S. Supreme Court ruled with a vote of 4 - 4 blocking USCIS to fully implement President’s Barack Obama executive order for up to 5 million undocumented immigrants to apply for Deferred Action for Parents of Americans (DAPA) and Deferred Action for Childhood Arrivals (DACA) which will allow accepted applicants receive a work permit along with a social security card and be differed from deportation.

 

The following quote is from a community leader from El Centro de los Pobres who would qualify for DAPA program under the executive order - Elizabeth Chavarria - "Personally It feels great, it’s a new hope for us all that need immigration reform or at least administrative relief. I was so excited when I heard what the Department of Justice did in correspondence to the Supreme Court on case with DAPA and DACA+"

 

Ezzie Dominguez from the Colorado Immigrant Rights Coalition stated the following - "I'm happy and excited that the U.S Department of Justice petitioned the Supreme Court to rehear the U.S vs Tx case. I live in Colorado and our state is one of the 16 states that supports DAPA and Expanded DACA. The community here is suffering by the injunction preventing implementation.  My family is suffering because of the SCOTUS decision that was made a few weeks ago and every time it is delayed my family could potentially be separated forever. This rehearing could make the decision fair because we want and need a final decision as it affects the lives of 5 million people. This rehearing will give us hope for a long term fight because I will not quit fighting for my family and families like mine."
